Former Metro FM presenter Masechaba Khumalo could not have possibly lost her virginity when Uyajola 99 presenter Molemo “Jub Jub” Maarohanye raped her if her father had violated her when she was a child.
Ntsako Baloyi, Maarohanye’s lawyer, stated this in the legal submissions he made to the National Prosecuting Authority (NPA), requesting the dismissal of the rape case Khumalo initiated against the Ndikhokhele hit singer.
In a police statement, Khumalo alleged that Maarohanye raped her while she was a virgo intacta.
Khumalo said she dated Maarohanye at the age of 16, when she was a pupil at Mondeor High School, Johannesburg, between 1999 and 2000.
She said Maarohanye invited her to his parents’ house in Naturena, southern Joburg, to watch a movie.
On arrival at his home, she exchanged pleasantries with Maarohanye’s parents, who were on their way out.
She said Maarohanye laid down on the living room floor under a blanket, eating popcorn while watching flicks.
She said they started canoodling and later moved to a bedroom. She explained that they moved to a bedroom after Maarohanye suggested it, as he didn’t want his mother to discover them drinking from each other’s lips.
She said that as she was lying on the bed with him, he allegedly aggressively pinned her down and climbed on top of her. In a bid to break free, she said she tried to push him off with her knees and legs.
She said that after failing to do so, Maarohanye allegedly raped her.
She said she told her parents about the alleged rape after Maarohanye announced on the Podcast and Chill with MacG that he had “smashed” her.
However, Baloyi dismissed Khumalo’s account, asserting that Maarohanye could not have deflowered her if her father had raped her before.
He said Khumalo publicly revealed to several media outlets that her father raped her when she was nine years old.
“In her disclosure of the ordeal, she made no mention of her alleged rape incident with the applicant that allegedly occurred on or about 1999 and 2000.
“Yet she does not hold back her eagerness to share it on social media. Not once has she ever mentioned being raped by the applicant. This is astonishingly strange. However, in her sworn affidavit, she states that the applicant raped her and knew that she was a virgin at the age of 17.
“Her allegation that the applicant forced himself onto her as ‘a virgin’ is false and therefore brings into question the validity of her claims against the applicant since her father raping her occurred at age nine for three days. It is far-fetched, impractical, and impossible to say the least,” Baloyi argued.
He further stated that Khumalo openly and comfortably spoke about her abusive relationships on the podcast, but none of which included her relationship with Maarohanye.
Baloyi said the reason was that there had never been a sexual relationship between them.
“These allegations against the applicant are seriously contrived, to say the least. While on the same podcast and any other live or recorded shows or social media, the third complainant instead used the opportunity to divulge her healing from the traumas of her past.
“Moreover, in spite of discussing and detailing her ordeal with the applicant, she can really and conveniently choose to remain selectively tight-lipped about it, which clearly demonstrates that it obviously never happened or else it would have formed part of the list of traumatic incidences she allegedly endured,” he wrote.
He said Khumalo opened the case against Maarohanye as part of the ‘Me Too’ campaign launched by Maarohanye’s ex- lover Amanda du-Pont.
He also said Khumalo recently praised Maarohanye for his talent in the Uyajola 9/9 show, which is aired on the Moja Love channel on DStv.
“If indeed the applicant sexually assaulted her, as she claims, how does she publicly acknowledge and praise him and then turn around and accuse him of rape? It just does not make sense,” Baloyi stated.
He argued that had Du-Pont not publicly claimed that Maarohanye raped her, Khumalo would not have sought to contribute to the ploy against the artist.
The NPA has withdrawn the case against Maarohanye.
